Overview:
Providing assistance through charitable organizations, such as churches and disaster relief organizations like the Red Cross, Salvation Army, World Vision, World Relief, etc. is something all of us understand and generally would support. It has long been recognized that charitable organizations, including churches, are frequently able to administer relief programs more efficiently than individuals acting on their own. Charities can offer assistance for short periods of time or even longer terms where required. Charities may even be able to offer assistance to employees under certain circumstances.
However, what most charities and individuals don’t always fully understand is how these assistance programs and activities need be organized, managed, and controlled to ensure compliance with applicable federal and state tax and payroll regulations. Would you know what to do if an individual approached your church with a gift they wanted directed to a particular family? What if an employee of your organization suddenly experienced an emergency hardship. Could the employer provide “benevolence” assistance? Would such assistance be taxable as income to the employee?
